Welcome to Stagoni! These are the terms of service that govern the supply of products ordered through our website, https://www.stagoni.com.au/. Please carefully read these terms before placing your order with us.

2. Placing Your Order

2.1 Your order will be accepted when we send you an email confirming its acceptance, establishing a contractual agreement between you and Stagoni.

2.2 In the event that we cannot accept your order, we will promptly inform you, and you will not be charged for the product. Reasons for rejection may include limited product availability, pricing or description errors, or automated ordering methods.

2.3 Once your order is accepted, we will assign an order number, and it will be helpful if you mention this number when contacting us about your order.

3. Product Information

3.1 We strive to maintain a website free of technical issues and ensure product availability. However, as our products are often part of limited production runs with high demand, we cannot guarantee constant availability. If your ordered items are unavailable, we will notify you as soon as possible.

3.2 Product images on our website are for illustration purposes only. Please note that color variations may occur due to monitor calibration and device operating systems. While we make every effort to provide accurate images, we cannot guarantee an exact match due to variations in home monitor setups.

4. Delivery

4.1 We offer shipping to most countries using Australia Post.

4.2 Estimated delivery times are available on our Shipping page. Once your order is dispatched, we will email you with confirmation and tracking details.

4.3 Delivery costs will be displayed on our website before checkout.

4.4 If you are not available to receive the product at your address, we will leave a note with instructions on how to rearrange delivery or collect the package from a local depot.

4.5 Responsibility for the product transfers to you upon delivery to the address provided during the ordering process.

4.6 Ownership of the products will be transferred to you upon receipt of full payment.

4.7 For customers outside of Australia, you are responsible for customs duties, taxes, and other import requirements. Please verify these details before placing your order. We are not liable for any customs-related charges, and refunds will not be issued for parcels returned due to non-payment or non-compliance.

4.8 If re-arranging delivery is unsuccessful, we may contact you for further instructions and may charge for storage and additional delivery costs. In certain cases, if we cannot establish contact or re-arrange delivery, the contract may be terminated.

4.9 In the event of delays caused by circumstances beyond our control, we will minimize the impact and notify you. If substantial delays occur, you may contact us to end the contract and receive a refund for undelivered products.

5. Price and Payment

5.1 The price of your order and delivery costs (including applicable sales tax) will be in Australian Dollars, clearly indicated during the ordering process. We accept payments via Visa, MasterCard, American Express, PayPal, ApplePay, GPay, ShopPay, and UnionPay.

5.2 For customers outside of Australia, the order price does not include overseas customs duties or taxes. You are responsible for confirming these details before placing your order.

6. Returns Policy

6.1 If you are not completely satisfied with your purchase, you can return the products for store credit within 14 days of receipt for online orders. The products must be in perfect original saleable condition with all tags attached and in their original packaging.

You are responsible for return shipping charges, except for returns of faulty items or products described/priced incorrectly. For your protection, please use recorded or registered post for returns.

Refunds, if applicable, will be made via the original payment method.

6.2 Due to limited product availability, we cannot hold stock for exchanges. If you are not satisfied with your purchase, you may use our returns policy as outlined in paragraph 6.1. If you wish to purchase a different item, you will need to submit a new order, bearing in mind that certain items may no longer be available due to limited production runs.

6.3 In case of pricing errors, we will contact you to either confirm the order at the correct price or cancel it. If the correct price is higher, you can choose to proceed or receive a refund for the price difference. If the correct price is lower, we will refund you the difference.

7. Termination of the Contract

7.1 We may end the contract for a product if you fail to make the payment within the required timeframe or if you do not allow us to deliver the products within a reasonable period.

7.2 If we end the contract under the circumstances outlined in paragraph 7.1, we will refund any advance payments for undelivered products. However, we reserve the right to charge reasonable compensation for any net costs incurred due to the contract termination.

9. Our Responsibility for Loss or Damage

9.1 You have legal rights under the law to receive products of satisfactory quality, fit for their intended purpose, and matching their description. These rights are not affected by these terms and conditions.

9.2 We are not liable for any loss or damage that could not be reasonably foreseen at the time of the contract. Loss or damage is foreseeable if it is obvious or both parties knew it might happen when the contract was made.

9.3 Our liability is limited concerning business losses. We supply products for domestic and private use, and we are not responsible for any loss of profit, business, goodwill, business interruption, or business opportunity related to commercial or resale purposes.

9.4 Nothing in these terms will limit or exclude our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law, such as your legal rights outlined in paragraph 9.1.

10. Other Important Terms

10.1 We reserve the right to change these terms and conditions periodically.

10.2 We may transfer our rights and obligations under these terms to another organization or deal with them in any other suitable way.

10.3 You may not transfer your rights or obligations under these terms to another person.

10.4 Only you and we have rights under these terms and conditions. This contract is between you and Stagoni, and no other person's agreement is required to end the contract or make changes to these terms.

10.5 If any part of these terms is found to be unenforceable, the rest of the terms will remain in force. Each paragraph operates separately, and if any is deemed unlawful, the other paragraphs will remain valid.

10.6 Delay in enforcing the contract does not waive our right to enforce it

later. If we do not insist on immediate compliance with these terms or delay taking action for any breach, it will not invalidate our right to enforce the terms at a later time.

10.7 These terms are governed by Australian law, and legal proceedings related to our products can be brought before the Australian courts.
